Terms of Service

1. Acceptance of Terms

These Terms of Service govern your access to and use of DevMarathon and any related services, features, content, or applications provided through the platform.

By accessing or using DevMarathon, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

DevMarathon may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.

2. Description of the Service

DevMarathon supports software-development workflows for individual developers and organization hiring workflows involving software challenges and candidate participation.

The platform may include features such as:

AI-generated outputs and AI Technical Evaluations are decision-support materials. They may be incomplete or inaccurate and may require human review before use.

Features may change, be improved, or be discontinued at any time.

3. Account Registration

To use DevMarathon, users must authenticate through GitHub.

By creating an account, you authorize DevMarathon to access certain information from your GitHub account, which may include:

Users are responsible for maintaining the security of their GitHub account. DevMarathon is not responsible for any loss or damage resulting from unauthorized access to a user's account.

Additional login methods may be introduced in the future.

4. Plans and Usage Limits

Solo
Individual developers may use free or paid Solo plans. Paid Solo plans may be recurring subscriptions. Current plan limits, included usage, and pricing are shown on the applicable pricing and checkout pages.

Organizations
Organization hiring workflows use a separate commercial model:

DevMarathon may introduce or change plans, pricing, included quantities, or usage limits in the future.

5. Billing and Payments

Payments for paid plans are processed through a third-party payment provider. At the time of writing, DevMarathon uses Lemon Squeezy as a Merchant of Record to process transactions. This means billing, tax handling, and payment processing may be managed by the payment provider. Payment providers may change in the future.

Recurring Solo subscriptions automatically renew unless cancelled before the next billing cycle. Users may cancel a recurring Solo subscription at any time. After cancellation, access to applicable paid Solo features continues until the end of the current billing period.

Organization AI Technical Evaluation purchases are one-time, non-recurring transactions. They do not automatically renew.

Unless required by applicable law, fees for subscriptions and one-time purchases are non-refundable. If you believe you were charged incorrectly or experienced a billing error, you may contact: hello@devmarathon.ai

6. Account Termination and Suspension

DevMarathon reserves the right to suspend, restrict, or terminate accounts at its sole discretion in cases including, but not limited to:

8. User Content

Users may create projects or generate materials through the platform. Users retain ownership of the content they create.

However, by using DevMarathon, users grant the platform a limited license to store, process, and display necessary information required to operate the service. Users are responsible for ensuring that any content they create or upload does not violate applicable laws or third-party rights.

9. Public Sharing

DevMarathon may generate result pages or links that users may choose to share publicly. If a user chooses to publicly share such links, the responsibility for sharing that content rests with the user.

In the future, DevMarathon may introduce community or showcase features where users may optionally display project information. Any such visibility will respect user permissions and applicable privacy considerations.

After an account deletion request is processed, DevMarathon will remove user data associated with the account where reasonably possible. However, certain information may be retained when necessary for:

DevMarathon is provided on an "as is" and "as available" basis. DevMarathon does not guarantee:

Users are responsible for reviewing and validating AI-generated content before relying on it.

12. Limitation of Liability

To the maximum extent permitted by law, DevMarathon shall not be liable for indirect, incidental, consequential damages, loss of profits, loss of data, or business interruption.

DevMarathon's total liability for any claim arising out of the use of the Service shall not exceed the total amount paid by the user to DevMarathon during the twelve months preceding the claim.

13. Modifications to the Service

DevMarathon may modify, suspend, or discontinue any part of the Service at any time. Features, limits, and pricing may change as the platform evolves.

14. Governing Law

DevMarathon is currently operated as an independent project and may later be incorporated under a formal business entity. Until such incorporation occurs, these Terms shall be interpreted under generally applicable commercial principles and applicable law where required.

Once DevMarathon is incorporated, the governing jurisdiction may be updated in these Terms.
